Terms of Use - KKE Circuit

These Terms of Use ("Terms") are a binding agreement between you (or the entity you represent) and KKE Soteco, operating KKE Circuit (the "Service"). By creating an account or using the Service you accept these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

1. The Service

KKE Circuit is an online tool for designing electric, pneumatic and hydraulic schematics. We may add, change or remove features from time to time. We will not materially reduce core paid functionality during a billing period without notice.

2. Eligibility & account

You must be at least 16 years old to use the Service. You are responsible for activity under your account, for keeping your credentials confidential and for promptly notifying us of any unauthorised use. You agree to provide accurate information and to keep it current.

3. Subscriptions, billing and trial

Paid subscriptions are billed in advance, monthly or annually, at the rates listed at /pricing. Annual subscriptions renew automatically unless cancelled before renewal.
Free trial: 15 days, no credit card required. At the end of the trial, you must subscribe to continue using paid features.
Taxes are added where applicable. Payment processing is handled by our payment processor; you authorise us to charge your selected payment method.
Refunds: monthly subscriptions are not refunded for partial months. Annual subscriptions may be refunded on a pro-rata basis within 30 days of the initial purchase if you have not actively used the Service.
Failure to pay: if a charge fails, we may suspend the account after notice and after a reasonable cure period.

4. Customer Content

You retain all rights to drawings, schematics, BOMs and other content you create or upload ("Customer Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, transmit, display and process your Customer Content solely as needed to provide and improve the Service. You represent that you own or have all necessary rights to the Customer Content and that it does not infringe third-party rights.

5. Acceptable use

You agree not to:

Use the Service for unlawful purposes or to violate any law or third-party right.
Upload malware, attempt to interfere with the Service, probe for vulnerabilities (other than through a published security programme) or circumvent rate limits.
Reverse-engineer, decompile or copy the Service except to the extent permitted by applicable law.
Resell, rent or sublicence access to the Service.
Use the Service to build a competing product.

6. Intellectual property

The Service, including its software, design, symbol libraries (other than Customer Content) and trademarks, is owned by KKE Soteco and its licensors. We grant you a limited, non-transferable, revocable licence to use the Service in accordance with these Terms.

7. Privacy

Our handling of personal data is described in the Privacy Policy, which is incorporated into these Terms by reference.

8. Termination

You may cancel your subscription at any time from the billing settings; access continues until the end of the paid period. We may suspend or terminate your account if you breach these Terms, fail to pay or use the Service in a way that exposes us or others to risk. On termination we will retain Customer Content for a reasonable export window and then delete it.

9. Disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Drawings produced with the Service are provided for design reference only - they do not replace professional engineering judgement, code compliance reviews or commissioning testing.

10. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential or exemplary damages, or for loss of profits, revenue, data or goodwill. Our aggregate liability for any claim relating to the Service will not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim.

11. Indemnity

You agree to defend and indemnify KKE Soteco against third-party claims arising from your Customer Content or your breach of these Terms.

12. Changes

We may update these Terms from time to time. Material changes will be announced at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction where KKE Soteco is established, without regard to conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the courts in that jurisdiction, except that you may have mandatory rights to bring claims in your local courts under applicable consumer law.
